These terms govern your use of Rural Prospector (the "Service") at ruralprospector.com. By using the Service you agree to these terms. If you don't agree, please don't use the Service.
These terms are plain-English. They're not a substitute for legal advice. Nothing here changes any consumer protection rights you have under the laws of your state.
1. What the Service is
Rural Prospector generates statistical reports for rural property addresses in Minnesota and Wisconsin. The reports synthesize public well-record, soil-survey, and water-quality data near a given address to produce estimates of drilling cost, septic feasibility, water-quality risk, and other property characteristics.
2. What the Service is NOT
A Rural Prospector report is not:
- A site inspection or assessment of a specific property
- A water-quality test of the well at any specific property
- A perc test or other soil suitability test for septic systems
- A licensed engineering opinion or stamped document
- Legal, real-estate, financial, or tax advice
- A substitute for a licensed well driller, licensed septic designer, environmental consultant, surveyor, attorney, or real estate professional
Reports are informational only. Final decisions about any specific property — including any decision to buy, sell, finance, develop, or build on a property — should always be made in consultation with licensed professionals who can examine the site directly.
3. Accuracy and data sources
We use public datasets from state, federal, and local government agencies. These datasets are sometimes incomplete, sometimes out of date, and sometimes inconsistent across agencies. We do our best to present them honestly, including flagging where data is sparse for a given area. We do not guarantee the accuracy, completeness, or timeliness of any individual data point.
Estimates such as "predicted drilling cost" or "septic system recommendation" are statistical inferences from nearby records. Real-world results may differ materially. Use them to narrow risk and budget, not as a final answer.
4. Payment and refunds
Reports cost $19 per address. Payment is processed by Stripe. By completing a purchase, you authorize the charge to the payment method you provide.
We offer a 100% refund within 30 days, no questions asked. See our Refund Policy for full details. When a refund is processed, access to the unlocked report is automatically revoked.
5. License to use reports
When you purchase a report you receive a personal, non-exclusive, non-transferable license to use it for your own purposes — including sharing it with your real-estate agent, attorney, lender, well driller, septic designer, or family members involved in the decision. You may not republish reports in bulk, resell access to the Service, or scrape report contents to power a competing service. If you want a commercial arrangement, email hello@ruralprospector.com.
6. Acceptable use
Don't use the Service to do anything illegal, to harass any person, to scrape data at industrial scale, to interfere with the Service's operation, or to reverse-engineer the underlying analysis to power a competing product. We reserve the right to rate-limit, suspend, or terminate access for users who violate this.
7. Disclaimers and limitation of liability
The Service is provided "as is" and "as available." We disclaim all warranties — express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Rural Prospector's aggregate liability for any claim arising out of or related to the Service is limited to the amount you paid for the specific report giving rise to the claim, or $19, whichever is greater. We are not liable for indirect, incidental, consequential, special, or exemplary damages.
Some jurisdictions don't allow these limits. In those jurisdictions our liability is limited to the smallest amount permitted by law.
8. Indemnification
You agree to defend and indemnify Rural Prospector against any third-party claim arising out of your misuse of the Service, your breach of these terms, or your violation of any applicable law.
9. Changes to these terms
We may update these terms over time. Material changes will be announced on this page, with the "last updated" date revised. Continued use of the Service after a change constitutes acceptance.
10. Governing law and disputes
These terms are governed by the laws of the State of Minnesota, without regard to conflict-of-laws principles. Any dispute that can't be resolved by direct discussion will be brought exclusively in the state or federal courts located in Minnesota.
